<h1>TERMS AND CONDITIONS OF USE HILTON SAN FRANCISCO UNION SQUARE AFFILIATE ONLINE ORDERING</h1>
<p>When ordering from this site, you agree to accept the following terms and conditions (the “Terms and Conditions”). PLEASE READ THE TERMS AND CONDITIONS CAREFULLY. If you do not wish to become bound by these Terms and Conditions, please do not use this site.</p>
<h2>TELECOMMUNICATIONS</h2>
<ol>
<li>Customer agrees not to resell, extend or misuse the connections or services.</li>
<li>Notification of cancellations must be received 2 weeks prior to the specified set up date.</li>
<li>Orders must be received 1 week prior to the setup date to guarantee availability of services.</li>
<li>Credit will not be given for service installed and not used. Services cancelled prior to install may be subject to a 50% cancellation fee.</li>
<li>All Long Distance telephone calls are charged at the AT&T operator dial business day rate plus 50%. A local call is $1.50 and a 800/877/855/866 call is $2.00 in addition to the $0.10 per minute after 60 minutes. Applies to all local, 800/888, calling card, credit card, collect, third party calls and calls made through other common carriers (950/10xx).</li>
<li>Hilton San Francisco Union Square reserves the right to terminate or disconnect services due to abuse or misuse.</li>
<li>Hilton San Francisco Union Square is not responsible for any equipment or cabling provided by the client or third party.</li>
<li>Hilton San Francisco Union Square is not liable for any service disruptions of any kind. Good faith and best efforts will be made to resolve with all parties.</li>
<li>Customer agrees to be responsible for full payment. This includes costs of calls for telephone services ordered.</li>
</ol>
<h2>ELECTRICAL SERVICES</h2>
<p>San Francisco City Code requires that no electrical equipment or apparatus be connected unless it conforms to its electrical code. Hotel will supply electrician to correct any minor infractions at stated labor cost.</p>
<p>WIRING REGULATIONS BASED ON THE ELECTRICAL CODE OF THE CITY OF SAN FRANCISCO</p>
<ul>
<li>All electrical apparatus and splices must be installed in a metal enclosure to prevent emission of sparks</li>
<li>All metal raceways. Metal lighting fixtures, metal housings of electrically powered equipment shall be grounded.</li>
<li>All extension cables shall be 3-wire SJ cord or other approved type and not more than 20 ft. long. One of the wires with green colored insulation is to be used as a ground. Cable must be large enough for the load and have grounded male plug.</li>
<li>Flexible cords and cables less than No. 14 gauge wire shall not be permitted.</li>
</ul>
<h2>FOOD AND BEVERAGE</h2>
<ul>
<li><strong>All orders are final once purchased, non cancellable or refundable</strong></li>
<li>Modifications/changes to existing orders must be received (2) weeks prior to specified set-up date</li>
<li>Due to food & liquor licenses, no outside food & beverage may be brought into the hotel</li>
<li>Per person package pricing is limited in the following time frames of service

<li style="padding-top: 5px;">Breakfast & Lunch……………………………….1 ½ hours of service</li>
<li>Anything beyond the 1 ½ hours of service will incur additional charges and must be ordered in advance</li>
</ul>

<p><strong>GRATUITY & ADMINISTRATIVE CHARGE</strong></p>
<ul>
<li>The combined gratuity and administrative charge that is in effect on the day of your Event will be added to your bill. Currently, the combined gratuity and administrative charge is equal to 25% of the total net food and beverage order ( plus applicable state and local tax). A portion of this charge will be a gratuity as calculated by the following formula and fully distributed to servers, and where applicable, captains and/or bartenders assigned to the Event.
<ul>
<li>Banquets/Coffee Breaks: 14.625% is distributed to food servers, bartenders, and bus persons (if applicable) serving the banquet. 4.875% is distributed to head waiters/waitresses, captains, maitre d's, and others. The remainder of the combined charge (currently 5.5%) will be a service charge. This service charge is not a gratuity and is the property of the Hotel to cover discretionary and administrative costs of the Event.</li>
<li>Buffets/Receptions: 18.75% of the combined charge received and shown on the check regardless of how it is specified by the guest or Group, shall be distributed to food servers, bus persons working the buffet or reception. 6.25% is distributed to head waiters/waitresses, captains, maitre d's and others. </li>

<h2>AUDIO VISUAL</h2>

<li>Customer agrees not to resell, extend or misuse the products or services.</li>

<li>Encore is not responsible for any equipment or cabling provided by the client or third party.</li>

<p><span style="font-family: arial, helvetica, sans-serif;"><strong>EVENT CANCELLATION / CHANGE:</strong> All orders are final and non-cancellable. Changes must be received minimum 2 weeks prior to event start date.</span></p>

<h3>Liability and Insurance</h3>
<p><strong>The Hilton San Francisco Union Square will not be responsible for any injury, loss or damage that may occur to the affiliate, the affiliate’s employees or property on both or to any other person, prior during, or subsequent to the period covered by the services contract, provided said injury, loss or damage is not caused by the hotel. Each affiliate expressly releases the hotel from such liabilities and agrees to indemnify the hotel against any and all claims for such injury, loss or damage. All terms, conditions, rules, regulations and pricing are non-negotiable. </strong></p>

<p>This Privacy Policy (the “Policy”) governs the manner in which Hilton San Francisco Union Square collects, uses, maintains, and discloses information collected from you in connection with the Hilton San Francisco Union Square online storefront.</p>

<p>Information collected may be used in connection with or for purposes of providing services to you, your business, and to others, improving services provided to you, your business, or to others, providing notices to you, complying with applicable law, and any other lawful purpose, including protecting the health or safety of you or others, and monitoring and preventing fraudulent or unlawful third-party activity.</p>
<p><strong><span style="text-decoration: underline;">Commercial Use of Information</span></strong></p>
<p>Hilton San Francisco Union Square will not sell or share the Information with third parties for any commercial purposes without your consent and express agreement. Hilton San Francisco Union Square may, however, use the Information in order to share generic, collective, group, or other non-identifying information about the use of Hilton San Francisco Union Square’s products and services as part of commercial transactions with third parties to help Hilton San Francisco Union Square improve its products and services or for any other lawful purpose.</p>
<p><strong><span style="text-decoration: underline;">Third-Party Service Providers</span></strong></p>
<p>Hilton San Francisco Union Square may use third-party service providers and vendors to assist Hilton San Francisco Union Square in providing its products and services to you and others, including, without limitation, services to host Hilton San Francisco Union Square’s Software Services, Storefronts, payment processes, and other services pursuant to the Agreement. Hilton San Francisco Union Square may also use third-party service providers and vendors to store Information and other data. Any such third parties would have access to your Information for the limited purpose of assisting, as reasonably necessary, Hilton San Francisco Union Square in providing Software Services and other services pursuant to the Agreement.</p>
<p>Hilton San Francisco Union Square may disclose your Information as Hilton San Francisco Union Square reasonably believes is required by court order, governmental directive, or other law, to protect the rights of Hilton San Francisco Union Square, or as otherwise allowed pursuant to the Agreement or applicable law.</p>
<p><strong><span style="text-decoration: underline;">Information Protection</span></strong></p>
<p>Hilton San Francisco Union Square will retain, protect, and process the Information and underlying or related data using commercially reasonable practices. Although Hilton San Francisco Union Square will undertake such efforts to preserve and protect the integrity of the Information, you acknowledge and agree that all security measures have potential risks.</p>
<p><strong><span style="text-decoration: underline;">Customer Control of Collected Data</span></strong></p>
<p>You may decline to provide or submit Information to us, however, some of our Software Services, Storefronts, or other services may not be available to you if you choose not to provide or submit Information. You also have a right to access the Information that we hold (about you) upon reasonable written request.</p>
<p><strong><span style="text-decoration: underline;">Updates to our Policy</span></strong></p>
<p>By entering into the Agreement or the Acknowledgment or by using our products or services, you consent to the collection and use of your Information by us consistent with this Policy and the Agreement. We may change this Policy from time to time, for any reason. Any such changes become effective when posted.</p>
<p>To the extent that this Policy is inconsistent with applicable law, it is the intent of Hilton San Francisco Union Square to comply with applicable law. If there is any conflict between any provision of this Policy and applicable law, such applicable law shall prevail; provided, however, that any such conflicting provision in this Policy shall be curtailed and limited only to the extent necessary to bring it within the legal requirements and the remainder of this Policy shall not be affected thereby.</p>
